Chelsea -striker Sam Kerr has been released from causing racially aggravated intimidation after he had called a big -urban police officer “stupid and white”.
The Australian International made the comments to PC Stephen Lovell during an incident in southwestern London in the early hours of January 30, 2023.
Mrs. Kerr, 31, and her partner, West Ham midfielder Kristie Mewis, were drunk when they were driven by a taxi driver to the police station of Twickenham who complained that they had refused to pay clean-up costs after one of them was sick and sick that one of them had hit them the rear window of the vehicle.
At the police station, Mrs. Kerr became “offensive and offensive” towards PC Lovell and called him “F ****** Dom and White”.
On Tuesday, a jury returned the non -culprit judgment after about four hours and 17 minutes at Kingston Crown Court since the previous day.
Judge Peter Lodder KC said after the verdict: “I look at the opinion that her own behavior has contributed considerably to bringing this statement.
“I am not going behind the jury's opinion, but that has a significant influence on the issue of the costs.”
Mrs Kerr showed no emotion while reading the verdict, but gave a thumb up to her lawyer Grace Forbes after the judge left.
During the trial, the court heard how Mrs. Kerr later accepted that PC Lovell called “Dom and Wit” during a heated stock exchange, but denied it came down to the indictment.
She said she regretted the way she expressed herself, but added: “I feel that the message was still relevant.”
She denied the use of “whiteness as insult” and claimed: “I believed it was he was using his power and privileges about me because he accused me of being something I am not … I tried to express that Because of the power and the privilege they had, they should never understand what we had just experienced and the fear we had for our lives. “
Asked if she said that PC Lovell was “stupid because he was white,” said Mrs. Kerr: “No”.
Mrs. Kerr and her partner Mrs. Mewis told the court how they felt “fired” by PC Lovell after explaining how they were “trapped” in the back of a taxi and “held against our will”.
Mrs. Mewis beat the rear window of the taxi before the couple climbed out of the vehicle, which was parked near the police station of Twickenham.
At the station Mrs. Kerr, her partner and PC Lovell came in an exchange, described in court as a “heated argument”, and Mrs. Kerr told the police “This is a racial f ****** thing”.
She said to the jury: “I believed that they treated me differently because of what they considered the color of my skin – especially the behavior of PC Lovell.
“The way he accused me of lying and later arrested for criminal damage, although Kristie said it was only she (who hit the window of the taxi).
“At that time I thought they were trying to give it to me.”
The Crown Prosecution Service originally decided not to accuse Mrs. Kerr, the court heard.
It can now be reported that Mrs. Kerr's legal team tried to have the case throw away during a provisional hearing, with the argument that there had been an abuse of trial by officers of justice.
During the hearing on January 14, Mrs. Kerr Grace Forbes 'lawyer said that the CPS had violated its own guidance, and added that a “Maas in the right of the victims' assessment arrangement was used to one year after the alleged to justify violation.
During the trial, PC Lovell stated that he only provided a statement stating that the comments of Mrs. Kerr had caused alarm or intimidation after that decision.
In his first statement to the CPS, the officer did not report the “stupid and white” remark with an impact on him, the jury was told.
The police submitted a request to revise the CPS decision not to prosecute, and it replied that the outcome would be limited to an apology, the court heard.
Public prosecutors later asked for further evidence and a second statement from PC Lovell was provided in December 2023, with the alleged impact.
He read a part of the statement to the court, which stated that the comments “made it shocked, upset and (left) me (left), I felt humiliated”.
The indictment was authorized later in December 2023, almost a year after the incident.
Mrs. Forbes said to PC Lovell during cross -examination: “You were determined to strive for this person, right?”
PC Lovell said “yes” and Mrs. Forbes asked, “Through the criminal courts?”
The officer replied “yes” again.
